These Conditions of Contract (hereinafter, General Conditions) regulate the process of sale of the products offered by Borja Corraliza Sánchez (hereinafter GeekColor) in the catalog available on its website www.GeekColor.com 

The General Conditions link GeekColor and the buyer (Client), granting them a series of rights and obligations, from the moment they make and accept an order through the aforementioned page. They are mandatory and knowledgeable by both parties, so their acceptance when registering as a Client is essential to be able to formalize an order. Therefore, the Customer must read these conditions carefully.

The headings of the different clauses are only informative, and will not affect, qualify or extend the interpretation of the General Conditions. 

These General Conditions will be regulated by the provisions of current legal regulations.

Any User of the Web www.GeekColor.com will be considered a Customer who places an order and gives its acceptance to it at the time of its realization.

The Customer must register as such and provide the following data in order to place the order: name and surname or company name, VAT number, billing address, delivery address, telephone number and contact email. At this time, you must accept these General Conditions. 

These data provided by the Client will be treated in accordance with the Conditions of Use of the Web page ("Legal" section) 

2. Purpose of the contract 
The purchase of the products offered by GeekColor on its website by the Client. These are products intended for private consumption. 

3. Offer process 
The offer is limited to the products that appear on the Web www.GeekColor.com, and is valid for purchases worldwide.

Each product has a file that collects the technical characteristics of the product, the brand, the model, images through digital representation (which may vary in the final product in shape and color depending on the monitor in which they are displayed), the sale price with VAT included in Europe and the period of availability of the same for its delivery and delivery to the Customer. 

The total cost of the order will be communicated to the Client at the time of placing his order and in advance of its acceptance. 
The price of the products is shown on the Web at the time of placing the order. 

4. Acceptance of the offer
It occurs at the moment in which the Client gives his express consent to the order placed. Previously, in the same register as a Client, he must have accepted the General Conditions. 

5. Payment of orders 
There are several forms of payment among which the Customer may choose. 
The total amount will be equal to the sum of the prices of all products plus shipping charges, additional services or forms of payment with separate commission. 

6. Delivery of orders

The delivery times of the orders depend on the availability of the product or products that compose them, availability that appears indicated in the cards of each one of the products of the catalog of the Web www.GeekColor.com. The terms of availability, for the purpose of calculating time for the delivery of orders, will be those that appear advertised on the page at the time of placing the order by the Customer. 

In the formalized orders in the modality of payment in advance, it will also be taken into account for the calculation of the delivery terms the reliable proof of the payment made by the Client by bank transfer or cash deposit in the bank account number indicated by GeekColor.

However, this period of availability may be modified in the case of simultaneous orders on the same product or products that lead to the end of the product's stock. The new delivery period will be indicated to the Customer in the shortest possible time. If the end of stock is final, the Customer will be notified to choose between choosing a different product with similar characteristics and a price similar to that of the sold out product, or canceling his order, returning the money paid.

Delays in sending the order exceeding ten days according to the availability period, delay attributable to GeekColor, will entitle the Customer to the cancellation of his order if he states in writing by email to the address info@geekcolor.com, returning , if applicable, the money paid in advance, and without any claim for damages, present or future, direct or indirect. 

The delivery times will depend on the type of shipment chosen by the Customer, they will appear during the purchase process. These deadlines are always approximate and at no time insured, therefore they will never be a valid reason for the rejection of the package or cancellation of the purchase or reimbursement of the shipping costs, the Client understands and accepts their acceptance.

Orders not delivered to the Customer within seven days of being sent for reasons not attributable to GeekColor will be returned to GeekColor , giving the Customer the possibility to send the order back paying the return shipping costs and the new shipment. If no response is received in 30 days Customer, the purchase will be canceled without any claim for the money paid, damages, present or future, direct or indirect. 

The delivery will be made door to door at the delivery address indicated in the order's shipping information. The subsequent modification of this address may generate a series of expenses that will be borne by the Customer.

The orders will be delivered by transport company at the delivery address indicated by the Customer and the person who has set as receiver of the same. These data will be entered in the delivery note of the transport company, which will also indicate the number of packages of the shipment and the total weight. 

Deliveries of bulky or overweight products, or products that present difficulties for delivery, will be delivered to the portal of the indicated address. 

In addition to the delivery note, a purchase invoice will be delivered to the Customer with each order, by e-mail.

If the invoice is missing, the Customer may request it by email to the address info@geekcolor.com, indicating the name of the invoice holder and the order number, and it will be sent again by email.

If at the time of delivery it is visible and clearly visible, without the need to handle the shipping packages or the product's own packaging, that a product has defects caused by transport damage or it is seen, in the same way, a error in the received merchandise, the Customer must consign it in the delivery note and communicate it to GeekColor (by email addressed to info@geekcolor.com) within 24 hours of receiving the order to urge the return of the product concerned and with it the replacement by a new one.

Defects in transport that are only noticeable after unpacking the product must be communicated in the first 24 hours from receipt of the order by email to the address info@geekcolor.com, indicating the damage caused to the product and urging the return of the product concerned and with it the replacement by a new one.

In the shipments by Ordinary Mail in case of loss, the client will be who will assume the total amount of the loss. GeekColor will not be responsible for the incident, since this type of shipments are not registered in Correos. If you make a purchase choosing this form of delivery is in accordance with these conditions, otherwise you can and choose another form of shipping. 

7. Cancellation of orders 

Only cancellations of orders will be accepted if your order has not yet been sent. The orders are processed automatically when confirming and paying for the purchase, so if you want to cancel it you can do so assuming the full cost of the product and obtaining a refund only of the shipping costs. If your order has already been sent, it can not be canceled.

The Customer's obligation is to ensure that the requested product is the one he wishes and in case of doubt about it, it is the Customer's obligation to contact GeekColor to learn about the product before its purchase. 

In the event that the purchase, once sent, is refused or not picked up by the Customer for reasons unrelated to GeekColor, it may claim the return costs of the shipment. 

8. Product warranty

The legal framework of guarantee (Law 23/2003, of July 10, of guarantees in the Sale of Consumer Goods) is intended to provide the Client with different options to demand sanitation when the acquired good is not in accordance with the contract, giving it the option to demand the repair or replacement of the property, unless it is impossible or disproportionate. When the repair or replacement is not possible or is unsuccessful, the consumer may demand the price reduction or termination of the contract. The products have a warranty of 2 years from the date of receipt of the shipment. The manufacturers of the products are solely responsible for the guarantee and provide the necessary technical and after-sales support. In the event that the Customer has any type of incident with a product,

By virtue of this, GeekColor will respond to the Customer for any lack of conformity that exists at the time of delivery of the products of the order, understanding these as tangible assets intended for private consumption. 

GeekColor's warranty is 24 months as a manufacturer. GeekColor in case of breakdown of one of these products will provide the Customer with the address to send it for repair or replacement. The cost of this return shall be borne by the Customer in any case. 
· If the defect comes to light during the first 6 months from the delivery of the good, it is presumed that the anomaly already existed when it was purchased and the consumer does not have to prove anything.
· However, when the lack of conformity manifests itself after 6 months and in doubtful cases, the manufacturer could demand an independent expert report to process the guarantee. In obvious cases of malfunction or irregular operation in warranty period there is no problem whatsoever. 
In any case, during the time that the consumer is deprived of the product, the calculation of the term of the guarantee is suspended; For example, if the repair of an object lasts 15 days, the guarantee period will end 15 days later than originally planned.

To be able to face this guarantee, the Customer will have to contact GeekColor by email to the address info@geekcolor.com in which it will indicate: name of the invoice holder, order number, invoice number and cause of the nonconformity

If it is necessary for you to send us your product for review, the shipping address and RMA number will be provided. Shipping costs will be borne by the Customer. Along with the damaged item, you must include the copy of the purchase invoice and the correctly signed warranty contract that the Technical Support will send you. After 14 days from the claim by the Customer to GeekColor, if the product has not been processed and delivered to the place indicated by the Technical Support, our department will not accept the claim and the RMA request will be canceled, rejecting the shipment if it were received. You can reapply for a new warranty procedure with a new RMA number whenever you want. If a damaged component is received due to poor packaging, we will not be responsible for the repair. Notifying the client of the problem and resolving directly by the Client and transport agency. Any material that does not comply with these characteristics will be sent back freight collect, even if the material complies with other parts of the warranty. If you choose an unsecured shipping method and the package is misleading, the Customer will be responsible for the loss.

-Process of guarantee. 

a) If upon receipt of the product it is verified that the fault is covered by the warranty conditions, once repaired or replaced, it will be returned to the Customer free of charge.

· Repair or replace. The first thing to do is send the product to repair or replace it with a new one. The choice falls on the seller, who will decide based on the costs generated by each option: if one of them is disproportionate to the other, the seller may choose the one that is most convenient to his interests, provided that the consumer does not assume greater inconveniences. In case of not having availability of the same item, will be exchanged for an article of equal or superior benefits, always informing about it and prior acceptance, and provided that the request by the Client is not disproportionate, as indicated in Law 23/2003, of July 10, on Guarantees in the Sale of Consumer Goods (BOE No. 165, of 07-11-2003)
·Price reduction or termination of the contract. When it is not possible (or reasonable) to replace the product with a new one, when the repair or replacement does not serve to leave the product in conforming conditions, when the time period is exaggerated ... the consumer may decide between asking for a price reduction or terminate the contract (as long as the lack of conformity is important). In addition, the consumer has the right to compensation for damages. 

GeekColor for reasons unrelated to the company, does not commit to the delivery of the product claimed within a specific period, being that period stipulated by the wholesaler or manufacturer, a term that will be duly communicated to the Customer by mail.

The return shipment will be made by Ordinary Mail, the Customer being responsible for any loss, damage or loss, in case of preferring an insured shipment you can choose to be returned by Certified Mail, having to pay $3.49. 

b) If upon receipt of the product it is verified that the equipment is working perfectly, it will be returned to the Customer, and the Customer will have to pay the transport costs generated as well as handling and verification expenses, estimated at a total amount of $9.99. The return shipment will be made by Ordinary Mail, the Customer being responsible for any loss, damage or loss, in case of preferring an insured shipment you can choose to be returned by Certified Mail, increasing the amount $3.49 plus, $13.49 in total. 

c) If upon receipt of the product it is found that the failure of the equipment breaches the warranty conditions, the warranty would be voided. The item will be returned to the Customer and must be paid for the transport costs generated as well as handling and verification costs, estimated at a total of $9.99. The return shipment will be made by Ordinary Mail, the Customer being responsible for any loss, damage or loss, in case of preferring an insured shipment you can choose to be returned by Certified Mail, increasing the amount $3.49 plus, $13.49 in total. 

Once the product has been shipped under review, the estimated expenses of $5.99 corresponding to any change of address or resend, either at the request of the Customer or because it is not indicated in the order, will be borne by the Customer. 
If a package is returned by incorrect address, be absent, not pick up or refuse, the Client will be notified when we receive it in our office so that he / she can choose what to do with it. In case of requesting a new shipment, you must pay $5.99 as shipping cost. You will have one month from the notice by us to agree a resolution, after this time without response will be considered that he disregards the purchase and renounces his articles and amount paid for them. 

-Nations of guarantee.

Warranty cases will not be accepted when the products have been used improperly or not according to their characteristics by the Client. 

The products are out of warranty for the following reasons: 

· Incorrect use, handling or maintenance by the Client of a device or component. 
· Burned components. 
· Broken or damaged components subjected to impact. 
· Incorrect repair, modification by the Client. 
· Malfunctions produced as a result of improper use or outside of the specified environmental conditions, defects in the installation, or wear and tear due to normal use. 
· Damage caused by disasters such as fires, floods, wind, earthquakes or storms.
· Cosmetic damage or scratches on plastic materials. 
· Damage caused by impacts with other objects, falls, spills of liquids or immersion in liquids. 
· Breakdown as a result of manipulations carried out by unauthorized technicians, as well as subsequent modifications or extensions not included in the original configuration. 
· Errors related to configuration errors or component incompatibilities. 
· Damage by accident, abuse, misuse or improper applications. 
· Deterioration due to normal use. 

9. Right of withdrawal

The Client is entitled to withdraw from the order within a period of 14 business days counted from receipt of the order, as set forth in Article 44 of Law 7/1996, of January 15, on the Regulation of Retail Trade, to exception of goods made according to the Client's specifications or clearly personalized, or which, due to their nature, can not be returned or may deteriorate or expire quickly; and requests for the supply of sound or video recordings, disks and computer programs that have been unsealed by the Customer, as well as computer files, supplied electronically, which may be downloaded or reproduced with immediate effect for permanent use. Our skins are manufactured after the Customer's order that personalizes it choosing their device and finished, 

The Client must communicate his withdrawal to GeekColor by email (info@geekcolor.com) within that period of 14 days. In this way, the customer can be informed of the procedure for returning the order (return number, shipping method and delivery address). Outside of this period, orders revocations will not be accepted. 

All merchandise must be returned in its original packaging intact, in perfect condition, without unsealing, or having been used. The Customer must adapt and take the appropriate measures of protection and packaging of the product for shipment to our warehouses. Otherwise GeekColor reserves the right to refuse the return.

The Customer who will be responsible for the direct cost of returning the product to GeekColor. Only in the case that the return is due to a shipping error or other causes attributable to us we will take care of the shipping costs. We do not accept any return postage due. The customer will be responsible for any damage caused during the transport of the return on the product. The returns must be delivered to the destination within 14 days after the date of receipt of the product. Otherwise it will be rejected and returned.

When the Client has exercised the right of withdrawal or resolution, once received the goods and found to be in perfect condition, GeekColor will be obliged to return the sums paid by the Customer less the shipping costs, payment commissions, return costs as bank fees, plus processing and cancellation fees estimated at $9.99. The refund of these sums will be made as soon as possible and, in any case, within a maximum period of thirty days from the withdrawal or resolution. 

10. Obligations of the Client To

11. Obligations of GeekColor 

Deliver the product in good condition at the place of shipment set. 
Respect the price of the orders agreed at the time of realization of them.

Receive the products that make up your order in perfect condition. 

13. Rights of GeekColor 

Receive payment of orders. 
Modify the prices established on your website for your products. 
Modify the delivery terms of the product depending on the availability of the same. 
Cancel orders due to Customer default. 
Cancel the Web without prior notice. 

14. Notifications

For the purposes of notifications, requirements and writings of any kind to which this contract gives rise, the address indicated in these General Conditions will be understood as the address of GeekColor. 

15. Validity of the clauses 

Even if the clause of this contract or one of its parts is declared invalid or unenforceable, the rest of the clauses or its parts will continue to be valid and have value. 

16. Applicable regulations

These General Conditions are governed by current Spanish regulations, and specifically by: Civil Code, Law 26/84 of June 19 General for the Defense of Consumers and Users, Law 7/98 of April 13, General Conditions of the Recruitment, Law 7/96 of January 15 on the Regulation of Retail Trade, Directive 2000/31 CE of the European Parliament and the Council of June 8, Law 34/2002 of July 11 on Services of the Information Society and Electronic Commerce, Law 23/2003 of July 10 of Guarantees in the Sale of Consumer Goods and the regulations that develop them.
